This Altcoinshub Terms & Conditions (hereinafter referred to as the Agreement), shall constitute contractual relationship between ALTCOINS HUB d.o.o. (hereinafter referred to as we, us, our or Altcoinshub) with its registered office at Aleksandrova obala 33, Zelenika, Herceg Novi, 85346, Montenegro, and you (hereinafter referred to as you, your).

PLEASE CAREFULLY READ THE TERMS AND CONDITIONS OF THIS AGREEMENT AND MAKE SURE YOU UNDERSTAND EVERYTHING BEFORE YOU PROCEED AS BY ACCEPTING THE TERMS AND CONDITIONS OF THIS AGREEMENT YOU SHALL BE BOUND BY IT.

In the case you disagree with this Agreement in full or any part hereof as well as the new updated version of it, please immediately stop using the services provided for hereunder.

1. TERMS & DEFINITIONS. The terms provided below are used hereunder exclusively for your convenience and does not affect its legal meaning set out by applicable laws. The following terms shall have the same meaning regardless of whether they appear in singular or in plural and be construed as follows:

BY ACCESSING OR USING ANY OF OUR SERVICES, INCLUDING BY CREATING AN ACCOUNT, E-WALLET, THROUGH THE APPLICATION, WEBSITE OR ANY OTHER OUR INFORMATION SYSTEM, YOU ACKNOWLEDGE AND EXPRESSLY AND UNAMBIGUOUSLY AGREE TO THIS AGREEMENT, ANY ANNEXES HERETO AND CONTRACTING AS WELL AS TO THE PRIVACY POLICY AND ANY OTHER DOCUMENTS REFERRED TO HEREIN.

The Effective Date shall be calculated upon performance by you of any of the actions specified in this Paragraph, which took place first.

3. SCOPE. This Agreement governs and applies to your access to and use of the Services. PLEASE NOTE, THAT UNLESS OTHERWISE SPECIFIED BY APPLICABLE LAWS OR REGULATIONS, ALTCOINSHUB IS NOT A BROKER, FINANCIAL INSTITUTION, CREDITOR OR ANY OTHER SIMILAR ENTITY AS WELL AS DOES NOT PROVIDE ANY FINANCAL SERVICES.

To access the Services, you may be asked to go through a registration procedure. Where the registration procedure is obligatory, to obtain an access to and use the Services hereunder you have to register within Altcoinshub’s information system by completing all the mandatory fields of the registration forms requesting the personal data referred to in the Privacy Policy , and go through AML, KYC and CDD verification procedures. In other cases, where Altcoinshub deems possible and appropriate without prejudice to the quality of the Services, you may be granted an access to the Services without such the procedures.

By registering on the Website, in the Application or any other our information system or using the Services hereunder you will become a user. To become a user and enjoy our Services, you are also required to be at least 18 years old and agree to the Privacy Policy .

If you provide any false, inaccurate, or incomplete information or fake documents, or if Altcoinshub considers that there are reasonable causes to doubt the accuracy, integrity, truthfulness or validity of such information or documents, Altcoinshub may deny or restrict you an access to, and use of, the Application, Website, Services, or any content included therein.

You agree to use the Services, including all features and functionalities associated therewith, pursuant to this Agreement, all applicable laws, regulations and rules, or other restrictions on use of the Services or content therein.

We regularly update the Website, Application, all the Services and all the content accessible through them. We also constantly test and monitor various aspects of the Services, including without limitation, promotional features, user interfaces, availability of the Website, Application, or any other content accessible through the Services.

Altcoinshub may, at its sole discretion, use commercially reasonable efforts to provide technical support for the Services. Technical support will be determined exclusively by Altcoinshub and may be provided, including without limitation, by way of telephone and email assistance. Altcoinshub is not responsible for providing technical support for any products, apps or services provided to you by any third party.

Altcoinshub may render the Services in person or engage for such purposes any third parties contracted with Altcoinshub or related thereto in any other form. Altcoinshub does not require any your consent to engage any third party to render the Services.

4. RISKS RELATED TO THE ASSETS. PLEASE NOTE, THAT ALL TRANSACTIONS INVOLVING THE ASSETS INVOLVE SUBSTANTIAL RISKS. In considering whether to hold the Assets or perform any transactions thereto, you must understand and be aware that the value or prices of the Assets are volatile and can change rapidly, and that past performance is not an indicator of future performance. In this regard, we are not in any way responsible for any losses you may incur by using the Assets or performing transactions thereto through the Services.

We are also not responsible for Assets market, and we make no representations or warranties related to the real or perceived value of the Assets as denominated in any quoted currency.

PLEASE NOTE, THAT WE DO NOT PROVIDE ANY INVESTMENT OR SIMILAR ADVICE, AND ANY CONTENT ACCESSIBLE THROUGH THE WEBSITE, APPLICATION OR SERVICES SHOULD NOT BE REGARDED AS A SUBSTITUTE FOR INDIVIDUAL INVESTMENT ADVICE AND USED AS A BASIS FOR MAKING IVESTMENT DECISIONS.

5. USER ACCOUNT. When the registration procedure, if applicable, is completed, our information system will automatically generate for you a unique set of data necessary to access your personal account therein and perform transactions therethrough, in particular it can be a password, private and public keys, two-factor authentication codes, wallet address or others.

You are responsible for safeguarding, maintaining security and control over the password, private key or other authentication data that you use to access your account and Services and for any transactions, activities or actions under such the password, private key or other authentication data whether such the data with our Services or a third-party social media service. ALTCOINSHUB IS NOT RESPONSIBLE FOR ANY LOSSES INCURRED BY YOU DUE TO UNAUTHORIZED ACCESS TO YOUR ACCOUNT OR ACCESS OF THIRD PARTIES TO YOUR PASSWORD, PRIVATE KEY OR OTHER AUTHENTICATION DATA USED TO ACCESS YOUR ACCOUNT. You must immediately notify us upon becoming aware of any breach of security or unauthorized use of your account or loss of the password, private key, or other authentication data.

You may not disclose, sell, rent, share or otherwise assign or transfer to any third party your account or private key, as well as any other authentication data necessary to access your account. You also may not allow remote access to your device or share your device screen with anyone else while you are logged in.

You may not use as a username, the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar, or obscene.

6. TRANSACTIONS. Any transactions as to the Assets within the Application, Website or any other our information system are performed through placement by you of the Order. Upon placing the Order, the system will automatically update your account to display the open Orders, and your Orders will automatically be included in Altcoinshub’s order book to match other users’ Orders. Provided one of your Orders fully or partially matches another user’s Order, our system will automatically execute a transaction. When the transaction is performed, your account will automatically be updated to display that the Order has been fully performed and closed, or the Order has been partially performed. The Order will remain uncompleted until it is fully performed or cancelled as referred to herein below.

You may only cancel your Orders prior to the moment they have been matched with other users’ Orders. When your Order has been matched with another user’s Order, you may not cancel, change, or revoke the Order. For any partially matched Order, you may cancel the unmatched part of the Order unless such portion has been matched.

To execute a transaction, you hereby authorize Altcoinshub, to temporarily have access to and/or control the Assets or fiat money engaged in your transaction. Altcoinshub is entitled to monitor, reject or suspend any Order or reject any cancellation request related to the Order you have placed.

If you don’t have sufficient amount of the Assets or fiat money to perform the Order, we may cancel the entire Order, or perform part thereof with the amount of the Assets or fiat money you have in your account.

PLEASE NOTE, THAT ALTCOINSHUB IS NOT A PARTY TO ANY TRANSACTIONS PEFROMED BY USERS THROUGH THE SERVICES, APPLICATION OR WEBSITE, AS ALTCOINSHUB ONLY ADMNINISTERS SUCH THE PLATFORMS AND PRIMARILY PROVIDES SAAS ENABLING EXECUTION OF SUCH THE TRANSACTIONS.

Some jurisdictions do not allow to use Assets as a legal tender for goods, work or services. Should you be a resident of or located in the territory of such jurisdiction, or such jurisdiction otherwise applies to you, you undertake to not use the Assets as a legal tender for goods, work, or services. Failure to comply with these limitations, shall constitute a breach of this Agreement. In this case, we may lock, cancel, suspend, or otherwise restrict your access to the Application, Website, Services, or transactions executed therethrough.

7. PAYMENT & SETTLEMENTS. Altcoinshub may charge you fees in the form of one-time or periodical payments for accessing and using the Services, including commission fees for executing the Orders. The relevant fees may be set and charged for all the Services as well as any portion thereof.

Altcoinshub, at its discretion, may set the amount to be charged for the Services by publishing the relevant information in the Application, on the Website, by providing links in the Application or on the Website to the sources through which the relevant information can be easily accessed by you, by email notification and in any other way which allows an unlimited number of persons, including you, to get acquainted with the amount to be charged for the Services.

Altcoinshub may, at its discretion, update the fees at any time. Any updated fees will apply to any Order and/or transaction that occur following the effective date of the updated fees. You hereby authorize Altcoinshub to deduct from your account any applicable fees that you owe under this Agreement.

Unless otherwise provided for by applicable laws, the fees set by Altcoinshub for the Services, shall exclude any taxes, fees, other mandatory payments, expenses related to bank charges, currency exchange, purchase, sale and conversion fees as well as any other additional payments and expenses that may occur when paying for the Services. Unless otherwise provided for by applicable law, you’re solely responsible for paying all the charges referred to in this Paragraph. All taxes and fees payable by Altcoinshub in relation to the income/profit received by Altcoinshub for provision of the Services, as well as other taxes shall be executed pursuant to applicable laws.

To access and use the Services as well as perform transactions, you must provide one or more payment methods suggested by us, including such as Visa, MasterCard cards or other available fiat or cryptocurrency payment methods. Our Application and Website, if applicable, may also allow linking third-party crypto wallets for alleviating the process of depositing crypto assets.

We may, at our discretion, engage third party payment providers and use their services to process and/or accept the payments due to us. Please note, that payment cards (credit cards or debit cards) are subject to validation checks and authorization by your card issuer. If we do not receive the required authorization, we will not be liable for any delay or non-delivery of the Services.

If technically possible, you may change or update the selected methods of payment through your account in the Application, on the Website or within any other our information system, if any, or in any other way specified by us.

We may also change or update the methods of payment and following such the change or update payments will be made subject to the changed (updated) methods of payment. In the latter instance, if the changed or updated payment methods differ from the previously used payment methods, you must choose and specify a new method of payments. In the aftermath of any change or update of payment methods, we’ll keep charging the applicable payment methods.

8. REFUND POLICY. Any payments you make to access and use the Services or make transactions are non-refundable, unless otherwise expressly determined by Altcoinshub or provided for by applicable laws, including, but not limited to, Altcoinshub does not refund fiat money or Assets paid for executed Orders or Services, or involved in a transaction.

Transactions as to the Assets, in particular cryptocurrency transactions are designed to be irreversible. CONSEQUENTLY, YOU MAY NOT REVERSE OR CANCEL SUCH THE TRANSACTIONS. PLEASE, BE AWARE AND CHECK ALL THE DETAILS OF THE TRANSACTION PRIOR TO APPROVING IT.

9. PROMOTION. Any Promotions made available through the Services may be governed by rules that are separate from these Agreement. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy . If the rules for a Promotion conflict with this Agreement, the Promotion rules will apply.

10. INTELLECTUAL PROPERTY. All copyrights, industrial property and other intellectual property rights to the Website, Application, any its parts or any content included therein and accessible through the Services, including without limitation, any texts, images, graphic designs, industrial designs, utility models, inventions, software, technologies, trademarks, patents, trade secrets and others, are exclusively owned by Altcoinshub and its licensors.

To access and use the Services, Altcoinshub grants you a non-exclusive, limited, non-transferrable, non-sublicensable, revocable license to use the Website and Application. Except as provided in this Agreement, you don’t obtain from Altcoinshub or other affiliates or persons acting on behalf of Altcoinshub any other rights, including without limitation, any related intellectual property or other similar or related rights.

You may not reproduce, archive, modify, distribute, display, publish, perform, license or sublicence, offer for sale or sell, create derivative works from, or use, except as explicitly specified in this Agreement, the Website, Application, or any other technology, content or information or any part thereof accessible, contained on or obtained from or through the Services. You also may not use any spider, scraper, robot or any other automated means to access the Website, Application or Services; reverse engineer, decode, emulate, disintegrate, reverse engineer, restore or attempt to restore the source code or protocols of, decompile or disassemble Website, Application, software or any other content or processes or any part thereof accessible, contained on or obtained from or through the Services or perform engineering analysis for such purposes; insert product, code or manipulate the content of the Website, Application or Services in any way; circumvent, alter, degrade, deactivate, thwart or remove any of the content protections in the Website, Application or Services; or use any data gathering, data mining, or extraction method. In addition, you’re prohibited to post, e-mail, send or otherwise transfer any material designed to destroy, interrupt, or limit the functionality of any software or hardware or telecommunications equipment associated with the Services, including without limitation any software viruses or any other computer programs, files, or codes.

If you violate this Agreement or are engaged in any fraudulent or illegal use of the Services, or otherwise fail to comply with this Paragraph, Altcoinshub may restrict or terminate your access to and use of the Services.

Any transactions as to the Assets while using the Services, does not entail any transfer (assignment) of any intellectual property, similar or related rights such the Assets contain or embody.

11. PERSONAL DATA. Your privacy is important to us, and we’re committed to protecting it. That’s why your use of the Services hereunder is also subject to our Privacy Policy . PLEASE READ THE PRIVACY POLICY CAREFULLY AS IT SETS OUT THE TYPES OF PERSONAL DATA ALTCOINSHUB COLLECTS FROM YOU AND YOUR DEVICES, HOW ALTCOINSHUB USES YOUR PERSONAL DATA, AND THE LEGAL BASES FOR IT.

To use the Services hereunder, in particular to have access thereto, and perform other obligations of ALTCOINSHUB defined herein, you must provide to us a certain amount of personal data. The list of such personal data is determined by the Privacy Policy . You must also provide to us any other reliable information necessary for the proper provision of the Services. Where processing is based on consent and to the extent permitted by applicable laws, by agreeing to this Agreement or by accessing and continuing to use the Services, including, but not limited to, by registering or creating an account in the Application, on the Website or within any other our information system, you consent to our collection, use and disclosure and transfer of your personal data as set forth in the Privacy Policy . Where necessary or required by applicable law, we may request your separate consent to processing your personal data as referred to in the Privacy Policy .

YOU HEREBY ACKNOWLEDGE THAT YOU HAVE ACQUAINTED YOURSELF WITH THE PRIVACY POLICY AND ARE DULY NOTIFIED OF THE AMOUNT OF PERSONAL DATA BEING COLLECTED AND PROCESSED BY ALTCOINSHUB.

12. WARRANTIES & REPRESENTATIONS. You hereby represent and warrant that:

12.1. you are at least 18 years old and all information and documents, regardless of the form (format) thereof, you supply to us in accordance with the terms of the Agreement, including during registration procedure, are accurate, true, and complete;

12.2. you are legally capable of entering into binding contracts under applicable laws;

12.3. entry into this Agreement does not in any way violate your rights and legitimate interests, as well as does not in any way restrict your legal capacity;

12.4. entry into this Agreement in no way infringes the rights, freedoms, and legitimate interests of third parties.

12.5. you have the legal right to use any credit or debit cards or other payment methods in connection with the Services and transactions performed through them;

12.6. during the use of the Services, you will comply with all applicable laws necessary to use the Services, including the laws of the country where you’re a resident.

13. LINKS TO OTHER WEBSITES. Altcoinshub does not monitor or review the content of third parties’ websites and services accessible through the use of the Services, Application or Website even if these websites and services are linked to from them as well as Altcoinshub has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. YOU FURTHER ACKNOWLEDGE AND AGREE THAT ALTCOINSHUB SHALL NOT BE RESPONSIBLE OR LIABLE, DIRECTLY OR INDIRECTLY, FOR ANY DAMAGE OR LOSS CAUSED OR ALLEGED TO BE CAUSED BY OR IN CONNECTION WITH THE USE OF OR RELIANCE ON ANY SUCH CONTENT, GOODS OR SERVICES AVAILABLE ON OR THROUGH ANY SUCH WEBSITES OR SERVICES.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

14. ENFORCEMENT ACTIONS. To ensure the compliance with all applicable laws and regulations as well as the Agreement, we reserve a right to monitor any transactions, any content or information performed, stored, transmitted, or otherwise processed through the Services, Application, Website, any other our information system or your account therein.
If you violate any terms of this Agreement, including any warranties set forth herein, any other rules and documents referred to in this Agreement, or fail to comply herewith in any other way, we may take against you, in particular the following enforcement actions:

14.1. lock, cancel, suspend or restrict your access to the Services, Application or Website, including any parts or elements thereof, for any period specified by Altcoinshub;

14.2. lock, cancel, suspend, restrict or otherwise interfere with your transactions, transmission of information or any other content performed through the Services;

14.3. lock, cancel, suspend, or restrict in any other way your access to your personal account in the Application or on the Website or within any other information system operated and/or administered by Altcoinshub, if any.

The list of the enforcement actions defined in this Paragraph is not exhaustive and we may take any other enforcement actions we deem appropriate provided the adoption of such measures assists or is necessary for protection of our or third parties’ rights and legitimate interests.

15. LIMITATION OF LIABILITY. THE SERVICES, ANY PRODUCT OR CONTENT ACCESSIBLE THROUGH THEM ARE DELIVERED TO YOU ON AN “AS-IS” BASIS AND WITHOUT WARRANTIES OF ANY KIND, EXPRESSED OF IMPLIED, GUARANTEES OR CONDITIONS WITH REGARD TO SUCH USE OF THE SERVICES, PRODUCTS OR CONTENT. You must understand that use of the Services hereunder is at your sole risk, and that such the Services may not be, in particular, error-free or uninterrupted. You waive all indirect, consequential, and special, damages against Altcoinshub as well as you hereby disclaim all warranties and conditions with respect to the Services, either express, implied, or statutory, including without limitation, the implied warranties and or conditions of satisfactory quality, of accuracy, of noninfringement of third-party rights. These conditions shall not limit or otherwise affect any of your non-waivable rights and warranties under your local laws, if applicable.

Except for the cases when the actions or omissions of Altcoinshub are an intentional breach of the Agreement, the latter shall not be liable for problems with the operation of the Application and Website caused by technical problems, actions of other users who use the Application, Website or any of their services, failure to perform or improper performance of obligations to grant access to use the Application, Website or technical support due to technical or force majeure circumstances, for any damage caused by the use of the Services, in particular damage caused by non-compliance with Altcoinshub’s instructions.

To the maximum extent permitted by applicable law, in no event Altcoinshub or its suppliers shall be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Services, third-party software and/or third-party hardware used with the Services, or otherwise in connection with any provision of this Agreement), even if Altcoinshub or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose. Some states do not allow the exclusion of certain types of warranties or limitations of liability for incidental or consequential damages, and on applicable statutory rights of a consumer, which means that some of the above exclusions and limitations may not apply to you. But in such a case the exclusions and limitations set forth in this Paragraph shall be applied to the greatest extent enforceable under applicable laws.

NOTWITHSTANDING ANY DAMAGES THAT YOU MIGHT INCUR, THE ENTIRE LIABILITY OF ALTCOINSHUB AND ANY OF ITS SUPPLIERS UNDER ANY PROVISION OF THIS AGREEMENT AND YOUR EXCLUSIVE REMEDY FOR ALL OF THE FORGOING SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU FOR THE SERVICES OR EQUIVALENT TO 250 USD IF YOU HAVEN’T PAID FOR THE SERVICES.

FORCE MAJEURE

17. You hereby represent and warrant that you will comply with all the requirements provided for by applicable law as well as law of the country where you are a resident, necessary to have access to and use the Services. YOU HEREBY ALSO REPRESENT AND WARRANT THAT YOU ARE NOT RESIDENT OF USA.

To comply with the requirements provided for by applicable laws, you must obtain, if applicable, from competent authorities, local governments and other competent bodies and entities all necessary permits, licenses and approvals required by applicable laws to access the Services.

18. ENTIRE AGREEMENT. This Agreement incorporates all agreements between Altcoinshub and you and documents by reference and is the entire agreement between Altcoinshub and you in regard to the scope of this Agreement. This Agreement supersedes all prior or contemporaneous agreements, undertakings, representations or communications between Altcoinshub and you, whether verbal or written, in regard to the scope of this Agreement. Altcoinshub and you will not be bound by any provision, condition or term that is different from or in addition to the provisions, conditions, or terms of this Agreement, except as provided for herein.

19. GOVERNING LAW & DISPUTES. This Agreement and the relationship between you and Altcoinshub shall be governed by and construed in accordance with the laws of England and Wales.
You and Altcoinshub hereby irrevocably agree to the exclusive jurisdiction of the London Court of International Arbitration (LCIA) for all disputes between you and Altcoinshub arising out of this Agreement or in relation hereto. Unless otherwise agreed by the parties in writing:

place of arbitration: London, United Kingdom;

arbitration language: English;

number of arbitrators: one.

Under all circumstances, if you have any concern or dispute about the Agreement or Services, you agree to first try to resolve the dispute informally by contacting Altcoinshub.

You may only resolve disputes with Altcoinshub on an individual basis. You hereby undertake not to bring or participate in any class, consolidated, or representative action against Altcoinshub or any of its affiliates or employees.

AGREEMENT CHANGES & ASSIGNMENT

Altcoinshub, at its sole discretion, at any time may assign or transfer the Agreement with you, including without limitation, its associated rights, and obligations. Altcoinshub does not require any your consent to such an assignment or transfer provided the information about this is duly notified to you as referred to in this Paragraph.

21. TERMINATION. Unless otherwise provided for by applicable laws, we may, at our sole discretion, immediately refuse to provide the Services and unilaterally terminate this Agreement as well as terminate or suspend your account without prior notice or liability, for any reason whatsoever, including without limitation if you breach this Agreement. Upon termination, your right to use the Services will cease immediately. If you wish to terminate your account, you may simply discontinue using the Services.

22. WAIVER. Except as provided for herein, the failure to exercise a right or to require performance of an obligation under this Agreement shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall be the waiver of a breach constitute a waiver of any subsequent breach.

23. SURVIVAL & INCONSISTENCY. If for any reason any provision of this Agreement shall be held to be invalid, illegal, or unenforceable, the validity, legality and enforceability of other provisions hereof shall remain If the provisions of this Agreement are inconsistent with the provisions contained in Policy, any other rules or document referred to in this Agreement, the provisions contained herein shall control to the extend necessary to resolve such inconsistency. If Altcoinshub provides a translation of the English language version of this Agreement, the English language version of this Agreement will control if there is any conflict.

24. MISCELLANEOUS. This Agreement does not create any third-party beneficiary rights in any individual or entity that is not a party to this Agreement.

The Agreement is available to anyone on the Website via the link referred to in Paragraph 1 (b) of the Agreement.

You may notify us of the fact of violation of your rights and/or legitimate interests, if such violation occurred during the provision of the Services or use of the Application or Website. To exercise such the right, you may notify us in free format of the relevant fact of violation by email or otherwise using the contact details of Altcoinshub referred to herein below. When the notification received, we, when applicable, may take reasonable measures targeted at restoring your violated rights and/or legitimate interests. If you have any other questions, you may also contact us via the same contact details. We’ll be glad to help you.
